Abstract

The rapid proliferation of digital technologies has transformed the landscape of commercial transactions, leading to the widespread adoption of electronic contracts (e-contracts). This socio-legal study critically examines the evolution, framework, and implications of e-contracts in India. The research explores the interplay between technological advancements, legal norms, and societal impacts, emphasizing the unique challenges and opportunities that arise in the Indian context. This study delves into the legal framework governing e-contracts, analyzing key legislations such as the Information Technology Act, 2000, and the Indian Contract Act, 1872. It assesses the adequacy of these laws in addressing issues related to contract formation, validity, enforceability, and dispute resolution in a digital environment. Furthermore, the research highlights the role of judicial interpretations in shaping the legal landscape of e-contracts. On the social front, the study investigates the impact of e-contracts on various stakeholders, including consumers, businesses, and the judiciary.
